SERVERS!!! i have to tip out %10 of my tips to the restaurant owner! i've been working at this place for a month and at first thought my %10 went to the kitchen. i found out that is not the case! the money goes to the owner! am i the only one that thinks that's nuts! there's NO BUSBOY, NO BARTENDER and NO HOST. so yeah, the servers pick up the slack of these 3 missing positions. plus the computer won't let us clock out until we claim %100 of our credit card tips. on a day like today where ALL my tips came from cc's, i made $120 except i actually took home $108...but still had to claim the $120! what's worse: if you're a server you know your tips get taken out of your paycheck too, plus you pay taxes on it! i've tipped out about $160 thus far, most of which i've had to claim, gotten deducted and taxed on! does anyone know if they are actually alowed to take my very hard earned money? btw: i live in florida, orange county. thank in advance to anyone who cares.

i'm not talking about claiming all my tips, i know i have to....i'm talking about having to claim $120 when $12 was taken out to give to the owner. therefore genius, i only made or took home $108. this is the 4th time i've had to claim the FULL cc amount even though i don't take home the full amount. BTW: anyone out there think the owner claims these "tips" we give him?

I maintained a large payroll computer system a long time ago. By law, the wait staff had to declare a certain amount per hour depending on the state they lived in. Way back then, it was a quarter an hour for California.

I don't know why the owner should get any of your tips. If you provide good service, the owner already benefits from satisfied customers and repeat business.

If you worked for a tip wage (currently $2.13 an hour, federal), the tips would be yours. Instead, your are paid a flat rate of ten dollars an hour, which means you're not entitled to any tips. It may seem unfair when tips are high, but when there are no tips and your rate doesn't drop, it's not so bad. Choose your poison, as they say, in the food service industry. You will find employers who pay one way or the other, but the chances you're going to find a place that pays above minimum wage AND lets you keep the tips are slim to none.

NO way do you have to give the owner any of your tips! They rake in the profits from the business already, now if this guy is taking your tips then hes desperate, and it sounds alot like desparation if he cannot hire a busboy or a bartender. Id say honey, go work elsewhere, this business is going downhill it seems. BTW no server is expected to surrender any of his or her tips to the owner of ANY establishment, that is totally ILLEGAL.

Wow - that's b.s.!! If you are forced to deduct 10%, then you shouldn't be taxed on it at the very least. The owner makes his money on the rest of the business, it shouldn't be off the backs of his servers that are keeping him IN business in the first place!

Well you have a choice.

Would you rather pay that 10% to the owner, or have your job ?

It's really that simple.

Because there is no way, you can report this to someone , to get it stopped, and keep your job.

The other question you seemed to have, is that you find it unfair that you have to report all your tips and pay tax's on them.

Whats unfair about that ? It's the law.
