A friend of mine and I got a phone together, the sales person said there were no activition fee and that the phone bill would be $69 dollars a month. My friend and I decided to go ahead and divide the bills to where each of us would pay roughly $40 a month. The first bill was little over $200 I went ahead and paid $100 and he still has not. Everything is in his name. We just got charged $50 late fee. Since I paid my share on time, should I have to pay for the late charge fee as well? Just doesn't sound right. My mother says, 50/50 means just that.
But I paid for my share on time. I personally don't think I should have to pay for late fees. Would I have to legally?

Legally, you don't have to pay anything, if its in his name. Ethically, you paid your part, and he didn't, so the late fee is on him. Get receipts, or pay him by check for your half from now on, so you have a record that you are paying your share.

It would not be fair for you to pay the late fee. If this person is your friend they would not ask you for any part of the late fee. Also try to get your own phone even if it is a prepay.

Unless you actually signed any kind of contract, you don't have to pay anything. Since you paid your orally agreed upon portion of the bill on time, the late fee falls in his lap.

And since the bill is in his name, it's his credit that will suffer, so it looks like he made a mistake, not you.

no you shouldn't pay any more then you did you paid on time the late fee is your friends fault.good luck
