Restating question because it was hard to follow.

About a year ago I purchased a piece of electronic equipment from best buy. with a two year store warranty

In the meantime the manufacturer boosted the warranty to 3 yrs

A month ago it broke
I called the manufacturer tech service and they asked for the serial number and advised me that it was totally broken and that they would send me an empty box for returning it.
I told them that i had a store warranty and they told me to just throw away the box when it arrived.

I did not send it to the manufacturer, I brought it back to Best Buy.
I received a new one free of charge because of my store warranty.
I assume that Best buy sent the defective back to the manufacturer for a replacement because it was still under the manufacturer's warranty.
Yesterday I received a new item in the mail by Fed-Ex
(no one signed for it)
I now assume that it was an internal mistake at the manufacturer's and I wondered if they would be able to charge me.

If an unordered item is shipped to you, generally speaking you cannot be billed for it. However, if the item was shipped as a genuine mistake you may need to return it (I'm not certain). I'd contact the manufacturer and ask them about the issue - it'd be polite, at least, to return it.

Naturally, I'm not a lawyer, and this shouldn't be taken as legal advice.

OK, a little more detail from the last time you asked the question.

The answer is till the same though. You're not required to send it back, but if you use it or throw it away you have to pay for it.

If you keep it, and in a few months they figure out what happened and ask you for it back (or ask you to pay for it) you can tell them that they have to come and get it. If you no longer have it, or if it's now used, they can sue you for it's value, AND make a police report and ask them to charge you with "illegal conversion" - which is a type of theft.

Man what is going on with Best Buy. The sent me an extra tv 2 years ago that I did not order and didnt pay for. I was going to send it back to them but they were trying to make me pay the shipping charge on it. Which wasn't going to happen at all. I ended up keep the tv and havent heard from them about it since.

Count your blessings and consider it a "gift". If you didn't sign for it, there is no way they can prove that you received it. For all they know, it could have been stolen from your doorstep. If you decide to sell it, be careful about making it a public add because they may see it. I would sell it outright without public advertising or donate it to an electronics repair shop.

Keep it. If you dont hear anything in a long time, sell it or exchange it.
