There are runners on second and third with one out. The batter hits a fly to center. Both runners start running but the center fielder makes a diving catch. He throws to second base for a double play. But the runner on third kept going and touched home long before the third out was made.

Does his run count, even though he never tagged up after the catch? If not, why not?

This is a time play. The run counts because the defense failed to appeal the base running infraction by the runner from third.

He does score....the play made at 2nd is the 3rd out....and since the runner on 3rd was never put out, he scores.

You can't get 4 outs...

A runner is not 'automatically' out for leaving early....he is only out when an appeal and/or tag up play is made on him....you don't make the appeal before the next pitch, he scores...regardless of the outs..

The OF'er shoulda thrown to 3rd

No - since he didn't tag up, he has no right to the next base. Think of it as if there had no outs - the run wouldn't have counted if he hadn't returned to the base first, so it wouldn't with 3 outs.

Batter has 1-1 count. Fouls a ball off his foot and is unable to finish his at bat. Is it an out or is there a new batter with 0-0 count

You have to tag, so the run doesn't count.

no, you cant score if you dont tag up.
