my partner has been previously married and his divorce is going through the courts and will take a couple of months. can we still do our notice of marriage to get the date we want and produce the papers later?

You can book the date etc but the bands need to be posted 30 days before ceremony and they cannot do this without decree absolute

DOCUMENTS REQIRED FOR MARRIAGE REGISTRATION 1. AGE PROOF OF BOTH HUSBAND AND WIFE (MARRIED OR TO BE MARRIED). 2. ADDRESS PROOF OF BOTH 3. MARRIAGE INVITATION CARD (IF ALREADY MARRIED) 4. 6 JOINT PHOTOGRAPHS OF 2 B SIZE. 5. RS. 115.00 AS PROCESSING FEES. 6. THREE WITNESSES. Note: a) There is no waiting period if the marriage is already held. But proof shall be provided. b) If Marriage is to be held by or before the Marriage Officer, the couple has to wait for one month which is the notification period. A notification will be published on the Notice Board of the office to invite objections from the public about this marriage. If there is no objection received in the prescribed period, the couple may go and sign in the prescribed register and get the certificate. Normally 3 certificates are issued freely. If more copies are required you have to pay some nominal charges. Now you are officially and legally married coupe. The certificate is accepted nationally and internationally.

It is always to wait until the decree absoulte and all other necessary arrangement for your fiance and his ex are made e.g financial arrangements for children etc.

Also take note, some courts may be delayed if one of the divorcing parties disagrees to one's desicion etc
so that is why I advise you to wait until the decree absoulte is recieved.
the decree absoulte takes 6 weeks, so bear in mind thats nearly 1 and 1 1/2 months gone

Valentine's right, I'm afraid you can't give notice of marriage without the decree absolute

NO, to give notice you have to have all the relavent paper work and that includes the decree absolute.
