Can any one can tell whether an Non Resident Indian can marry a Indian living girl without meeting each other with mutual consent of girl & boy and their famiies. I want to marry a girl living in India but I am working in abroad. I want to finish my marriage from abroad itself so that i will have a legal marriage certificate which is mandatory to bring wife to stay in the foreign country. Is our Indian consitution permits this to marry with mutual consent but without physical presence

No. Neither the any Indian law relating to matrimony nor the Indian Constitution provides any such marriage where you can marry with an Indian woman sitting abroad & calling her abroad on the basis of any certificate issued for such marriage. The marriage in India between the bride & groom takes place in their presence by the Priest according to religious form of marriage or by the Marriage Officer/registrar according to the civil/court marriage under the Special Marriage Act, 1954. The legal or valid marriage certificate that you require to bring your wife to the country where you live & work now has to be one issued by the Marriage officer under the Special Marriage Act or the marriage preformed according to the religious form but got registered by the marriage registrar under the Special Marriage Act or under the Hindu Marriage Act, 1955 (in case it is between two Hindus). The visa or immigration required on the basis of marriage is NOW being allowed on the basis of these above mentioned Marriage Certificates for all most all countries of the world. But to obtain any of these marriage certificates your presence is required in the country & before the Marriage officer/registrar. These criteria of presence of both the parties to the marriage cannot be ignored by any marriage officer or the marriage registrar appointed for these purposes. Just take month & half leave, come to India , get married according to any form you like, get the valid marriage certificate from the marriage officer or registrar, apply for the visa of your wife on the basis of this marriage certificate & fly back with her to your country of work & present living. Hope this legal position is clear to you now.
