Aside from the fact that it would not pass today, there is no such thing left in international law as a declaration of war (that concept is pretty much an eighteenth century idea).
Declaring war is a violation of the United Nations Charter (which is why there has not been a declaration of war since 1946). If a country were to declare war, that would justify military action against that country under international law. To avoid this legal problem, the current preferred mechanism is resolutions authorizing the use of force against countries that are alleged to be destabilizing the peace, preferably pursuant to a U.N. resolution. From a constitutional law perspective, a resolution authorizing the use of military force against a country is the equivalent of a declaration of war.

These days, like, you just, you know, start a war? So OMG Iraq was totally, like, WTF, and we were so, so, you know, KABOOM! Keep up with the times dude...
Also Ron Paul has every reason to be so outspoken because the Constitution (you know, the document that we all agree upon as a society and country that allows us to live freely and responsibly) SAYS ONLY CONGRESS CAN DECLARE WAR!
