If a website conducts a contest and I were submit a story about a person and a photo of them, is that illegal? If it is, who is liable, me or the website owner? I ask because there is a contest and the website asks for your story and you have an option of submitting this persons photo to go along with the story and they will be placed on the page for viewers to vote on. Any help would be great....Thanks!

If you own the copyright of the photo (Usually that means that you took it), or you have the permission of the copyright owner, then it's legal. Otherwise, it isn't.

Contrary to what another answerer said, that a photo has been publically distributed - eg posted on the web already - does NOT mean it's ok for someone else to use it. It's 'exactly' the same as a photo from a book, or magazine, or newspaper - it still belongs to it's copyright holder.

Nor is the permission of the person the photo is taken of relevant. If you're somewhere that I can see you, and I take your picture, *I* own the copyright to the picture, and I can do what I want with it - that's how the paparazzi make a living.

Wow! Not sure how to respond to this one but please pardon me for saying that your husband is a sleaze and is not going to change. I have in the past received such treasures from my wife but never in my most drunken stupor would I even consider sharing them with anyone else at all. I'm sorry if I seem offensive in this but officer or not your husband needs professional help. He is not going to stop! I would think violated is an understatement. I personally would be furious. I don't see you personally being able to change him. From your account he has lied to you at least twice. It's gonna happen again unless you do something about it. I reiterate, he needs professional help and even then it will probably take quite some time for any positive results. It is after all an addiction. You need to decide just how much you are willing to put up with. Consider your options. Divorce is drastic especially if there are children involved but it could come to that. After a one year deployment he has probably developed a taste or need for this stuff and it could easily get worse. Are you sure there are no web cams secreted around the house? Again, sorry if I seem offensive I don't mean to be but this is serious. Good luck to you in this.

It's seriously uncool.

You would be liable - you're liable on any site on which you post pictures or anything else personal about another person. Not the website. You agree to that when you click "yes i agree" when you sign up on most any website. That's why you have to register for things, so you agree to the terms and take responsibility. They all have hold harmless clauses or indemnity clauses or an equivalent in the TOS.

If its a publicly distributed photo (e.g. on the net) then no its totally legal.

If you took the picture yourself or somehow obtained it without their permission then you need to ask their permission.

Both you and the website could be liable.

Although it is unlikely someone would pursue legal revenge unless the photo was of them naked or doing something embarassing.

I wouldn't do it. Even if they are illegal.

You and the person who has the website would be liable.

If I found out someone had my picture on their website without my permission I would sue the both of you for defamation of character and probably issues with privacy rights.

There has been cases where people in other countries can use in the US or US citizens can sue people in other countries who take their pictures and post them with comments with out their permission.

The way I think of it is karma... you know what goes around comes around.

well yes it is illegal... only if you dont have a permission from the person... You have in the Picture.. thats about it


so ask before posting the picture
