Ok so i had an angry neighbor call the CAS on me(CPS equivalent) and of course the allegations were unfounded but while in the doctors office today i noticed a letter from the CAS thanking my doctor for speaking to them(here in ontario you have to sign a waiver to give consent for the doctor to speak with those officials) and i was blown away and shocked.
I kept reading and find that the CAS were able to ask and obtain my medical records in regards to my pregnancy.
I am very angry that these people were allowed to obtain information about me and my kids from my doctor, the doctor said he asked about a waiver and they claimed i signed one which i didn't.
Its not that i have anything to hide or anything like that i just feel that each patient child or adult has the right to doctor/patient confidentiality.
I just cannot believe that they were able to lie and get what they wanted and just wanna know from you out there do you think i have a right to file a complaint?

The doctor also told me he requested a copy of the waiver i supposedly signed 2 months ago and he said they have never given him one.

i NEVER signed anything with the CAS or my doctor because i don't think having strangers pry into mine or my childrens lives is really any of their business and the law states is a child is at risk of anything and the doctor feel concern he should notify the CAS or the police.

Yes, your rights WERE violated. Furthermore, with the right amount of complaining, you could have your doctor punished by his medical governing body. Unfortunately, I don't know what the CAS is, but as far as intrusiveness goes, they ALSO know that said waiver should be present...and should have asked to see it. You should take an ad out in the local newspaper asking if anyone else has had their doctor/patient rights infringed upon by that doctor/hospital....I'm personally curious to know just how shabby of an operation they run.

You can file a complaint with the agency itself. You can also, if you want, file a complaint with whatever Ontario agency disciplines doctors, because he really should have asked to SEE the waiver before releasing your results.

You should, of course, find a new doctor BEFORE you file that complaint. When you file it, your current doctor will de-list you, and many doctors are very reluctant to take on a new patient who's filed such a complaint, so you should change doctors first if you decide to make a formal complaint.

Did you ever sign "anything" with CAS? If so, there was almost certainly some language buried in there somewhere that authorized them to obtain your medical records from your Doctor.

In any event, if the CAS complaint was ruled unfounded, then you have no case for a lawsuit, because you have no measurable damages. Had they prosecuted you, then you could have moved to have the records they obtained supressed as illegally obtained.

i hope u wont mind, coz i dnt know what CAS is, coz i live in the philippines. id just like to share my views. in our country, any agency are not allowed to give info unless it is already in the court. they will be summoned. so in the first stage of investigation, parties are equal to defend their sides. in this stage, i dont think so the doctor must have given any info abt you, there is a privacy bet you as his client, esp that u did not sign a waiver. btw, have they shown you the signed waiver theyre saying? if they cant provide you with that, you have the right to file a complaint for violating ur rights.

Yes they invaded your doctor patient confidentiality. I would go to the Crown Authority, in America the District Attourney and file a complaint. Get a lawyer and sue.

If you have to sign a waver for them to get the records , then yes you have every right to file a complaint. Others need to know that this is happening. They have to follow the laws, just as you do, they overstepped the boundaries, and it should not be allowed

yes. and it is your doctor not "seeing" a waiver first that is the error. He is the guilty party. Go to him to settle it or go to another doctor who is not so lax.

yes the doctor should have seen proof of your consent and then acted accordingly.
