We have been living in the same house for the last three years.
Things are now not good and i just want to get out.
If i leave is that desertion if we are not married?

No way, you guys aren't married. So legally, you're nothing more than roommates. If your name is on the mortgage or lease you will be responsible for that though.

Good luck, moving on is always a tough decision to make.

Well, ethically no, but you'll have to check your state laws about common law marriage. After that long she does have dependencies on you and you on her and yes it is possible that you be in some kind of legal term oil if she takes it that far. Git on the net under your state laws and find out, first.

i dont think so if you dont have kids together. i think it depends on what state you are in perhaps you should CONSULT an attorney
