I was an employee with Ernst and Young's IT Audit Practice for two and a half years.. During that time, I was an experienced Staff within their IT Audit Practice.. One year passed by and I was not promoted to Senior.. This was normal as I had not been with the firm for a full year.. However, during my second year, I was passed over yet again to being promoted to Senior.. Because I was passed over two years in a row, HR immediately held a meeting with myself, our leading practice Partner, and our HR Coordinator.. The HR Coordinator and the Partner sat me down and said that because I was passed over twice to being promoted, I was going to be terminated.. However, in all of my engagement reviews, I received rave and positive reviews.. All of my Managers indicated in my reviews that I was ready to become a Senior.. When I brought this to HR and the Partner's attention, they said what was written did not accurately reflect everyone's feelings during our Year-End Reviews.. Can I take action?

If you are of minority status then I would pursue the situation. They would fold over not to have this in the news but if you are not you probably don't have a leg to stand on. Another thing to think about is if you pursue this action how would not getting or getting a bad reference affect your next position especially if you would have no trouble getting another job doing the same thing.

It appears that there is a missing piece of the puzzle here as to whether or not you didn't mention the whole story or they didn't reflect something that was said about you during your time there. Anything is possible like dealing with or having certain people seeing you on the outside in your personal life doing something that was not of standard to them. Questions such as (and I mean nothing personal) Are you gay and a staff member higher up found out?, Did you get into a drunken rampage and a co-worker saw you in a club one night? Where you screwing someone on the job and dumped them? Anything is possible and they wouldn't divulge such info in an exit interview as to not give you a reason to sue, etc.

You can go to the Department of Labor(Federal) in your area and see an advisor. They will contact your former employer and have a conversation discussing all the issues. Your employer will cooperate as nobody wants trouble with the Feds. If you can 't get your job back in the end you want it on record that you resigned and were not terminated. That's all an employer puts down, either,"Resigned" or "Terminated". That can be devasting as terminated means you got fired and your new employer if you get one has no means to find out the reason. That's a biggie. Good luck.

You need to carefully review any employment contract you have. Most employers these days are "At Will" employers which means they can pretty much terminate you for any reason at any time. But if you have a contract that guarantees promotions or defines the promotion criteria you may be in a good position to negotiate.

It sounds like they believe you were not advancing at the rate they determine is necessary to maintain employment. You can take action, but that can be a tough one to win unless you have some indisputable evidence of wrongdoing on their part. Also, they have more money for lawyers to fight you.
