A criminal background check is not the same as a credit check. Criminal records are a matter of public record, unlike credit histories. Anyone can run a criminal background check on anyone else without the permission of the subject of the check. I could run one on you right now and there would be nothing that you could do to stop me. Criminal records probably won't show up on a credit check anyway so separate inquiries are needed.

There are databases of tenant data that landlords can subscribe to to get rental history information. And the simplest check is simply asking your previous landlord. If you refuse to provide that little tidbit of information the LL is under no obligation to rent to you at all.

They can check your references that you put on your application for the rental history, and if they have your social, they can easily check your criminal background.

Court eviction and judgment checks can be done online (free) with only a name.

Criminal checks can be done with only a name and birthdate.

Your previous landlords can be called and questioned regarding yor tenancy if you provided that info on the application.

Do they have your social security number? That's all they need to run a history on you.
