and it was completely her fault. she admitted it to the police and everything. now she had an insurance policy that was actually canceled but i didn't find out til later. she then gave me a policy and said it was her new insurance but it turned out she got that insurance 11 days after the accident. now i had to go to the hospital after the accident because i was 32 weeks pregnant so i needed to make sure my baby was ok. and the ems bill just came. i also have the tow truck fees that i paid and then it'll be 200 dollars to fix my car (i know a few mechanics) so all in all it'll be about 1700 that i'm asking for from the other party. i'm not going to try to sue them for all they're worth or anything like that. i should tho because all they've done is give me the run around over and over AND i ended up having my baby early and the doctors suspect the wreck was why. so if i take her to small claims court i would win right?

i have all the receipts, from the junk yard, ems, and i'll get a quote from the mechanic. i also have the insurance claim denials from both insurance companies. and i can get the cop to testify that she said it was her fault. and that's what the police report says. open and shut right?

and yes my baby is ok. we were in the hospital for a while but he's perfectly healthy and happy now. and almost 3 months old

Consult an attorney- only negotiate through a lawyer, not directly with the person in the accident.

You don't need a Lawyer for Small Claims Court and it sounds like you have all the proof you need to sue her. So Go for it, you will win for sure!!! By the way how are you and your baby doing? is the baby okay? Take Care and God Bless!!

You shouldn't need a lawyer for small claims court.


It sounds like it's pretty much open and shut.

It's open and shut. Without insurance she is liable for the damages she caused including medical.

This actually happened to me (I live in Florida but may be use full in your state). At the time of my accident she said she had insurance. This turned out to be a lie. So I contacted the department of transportation and let them know she had falsely represented the status of her insurance. They issued her a ticket for driving without insurance and causing property damage. They also suspended her license. In order to obtain her license back, she had to contact me and make payment arrangements. I got back my money, and she go back her license.

Also, its a crime to falsely represent your insurance.
