Husband has possession of the car and is to pay the loan payment as agreed to in a dissolution of marriage agreement. The dissolution is final. If husband defaults on the loan can the title and possession of the car be transferred to the wife? Or if car is repossessed, can the wife reclaim the car if all back payments and fees are paid, and will the title be put in her name?

I don't know, but I would certainly have my atty file contempt charges and anything else he could if the ex defaulted on the order...

No, wife cannot get the car if husband defaults. The loan company will repossess the car and not ask questions about who else might pay it. They just come in the middle of the night and it's gone. You'd have to come up with the entire loan amount at that point to claim the car, I'm pretty sure. You should give the creditor a call to ask them though. Maybe they can work something out with you.

I would believe he would have to be present,agree to signing it over with a lawyer present at the DMV and to have it notarized. The loan company would then issue the title in your name with a payment schedule.
