If here being held awaiting trial, it is up to a federal court judge and the deputy attorney genral. If they have been convicted and are in federal prison, it is up to the parole board or a pardon from the president would free them.

The FBI doesn't hold anybody. After they arrest someone, that person is held at a Federal facility run by the Federal Bureau of Prisons.
