Well, i suppose you wouldn' t need DNA if you have a credible eye witness that watched the whole thing.
DNA can be planted, but that would probably speak to murder victims more so.
DNA seems to be the clincher that no one can refute, without it, I guess we need to find a way to get over the He said, She said cases.
Thus the example of the Duke Lacrosse players that were falsely accused by a stripper for rape.
The problem I personally have with cases like this is the victims never really get vindicated. 61 liberal insensed professors wrote / signed a letter condemning these boys for doing something it turned out they never did.. No retraction or action has been taken against these goodie goodie liberal do gooders.
The DA is also in a process of defending himself since no DNA could be found to link the boys either, yet they were going to be prosecuted anyways. Cases like this always hurt women in similar circumstances but that were actually raped. Yet to my knowledge, no action has been taken against the stripper either.
Meanwhile, the 3 boys are suing regarding the whole incident. Just more tying up of our justice system.

Rape is a very difficult crime to get a conviction. DNA evidence only proves the presence, not the crime.
Heck, some guy strangled a woman in Central Park and claimed it was "rough sex." He went to jail for a couple years, that was it.
