How do Stubhub or other online ticket exchange systems (Ticketmaster has one) skirt the issue of "scalping" found in many states?

By selling tickets at face value only, and making their profit from a "service fee".

Stub hub is a service that allows people to bid on tickets like an auction. It is the responsibility of the buyer and seller to make sure they are obeying whatever scalping laws are in effect for the states they are living in.

Ticketmaster has the same caveat - it is the seller's responsibility to stick to the law.
