I keep reading that the mexican drug smuggler involved in the beating of Ramos and Compean border patrol agents intends to sue the Border Patrol. How is this possible?

I thought the US government could not be sued...?

Also, if that is the case, can the US government counter-sue the Mexican government for the millions of illegal aliens living in our country?

The government enjoys what is called "Soveriegn Immunity", which means that it can't be sued unless either A) There's a law that says it can be in a certain situation, or B) It gives the plaintiff permission to do so.

The Civil Rights Act specifically gives people who claim to have been abused by Federal Law Enforcement officers the right to sue their agency for the abuse.

Whether Ramos and Compean or the Mexican alleged smuggler is telling the truth is a "question of fact", which means it's up to a jury to decide.

(Incidentally, I use the term "alleged" simply because he cut a deal and was thus never actually convicted in court. I don't believe there's actually any "practical" doubt that he is)

Well, I imagine that if Mexico doesn't keep good records, all the poor and uneducated people tracking north to America that we are capturing and dumping back into Mexico, the officials could say that we are just digarding all the people we don't want in our country.
With no proof of where they come from, as if everyone has a tatoo on their butts where they were born, They could claim we are economically causing them stress and destroying their contry.
Ya, I know, that's rich and meant as a parody, but who know's. It could be true or some other dumb scheme Mexico might pull on the USA just to get compensation. Personally I think they might want to keep their population under control. The world is full of enough poor and uneducated. And if they can't help, protect or save them , then why are they trying to push their problem onto America ?
Maybe we need to stop supplying condum programs to High School and send them to Mexico .

They can sue, that doesn't mean that they can win....
