I don't know what the legal definition of non-toxic is. Presumably, if the marker was made with nontoxic colorings and scotch whiskey as a solvent, it would be considered non-toxic, although it would smell. And the smell could effect you, although it should not be harmful.

I'm not a chemist,just using common sense.The ink may be non-toxic,but he oil base chemical to keep it fluid may have a "parts per million" ratio so low it allows to pass Federal Guidelines. Abestoes was deamed to be bad for general health in the sixties, but they continue to make brake pads for cars with it to this day,why ? Because the "parts per million" ratio passed guidelines. The " affect" may be headaches, but the "effects" may be minimal.
