there is a law about recording ppl with out their knowage illegal but what about people that are being bullyed/harrased this law diminshes hope for victims and i have been a victim and decided to break this law by recording harrassment becuase i was desperate i was warred by police that recording that was illegal and if the bully wanted to sue/take legal action then he could but i was susidal and wanted to kill my self so i did it i did not get counter sued and i did not need to take him to court because it stoped after the police said we have proof that you are bullying/harassing this man but what if i was too scared about that law and did not record this stuff happening? my answer is i would have killed myself the only thing that stoped me was deciding how to kill myself abnd then deciding to break that law who says the law should change

I am glad that this situation has been resolved for you.

The underlying problem with recording are two-fold, the first that everybody has the right not to be filmed/recorded without our consent or warning. So if you had put a sign up warning the bully it wouldn't have worked. The second problem is that audio can be changed to say whatever you want it to say - it;'s quite simple and the average computer has enough software on it to do the task - hence audio tapes are not acceptable as evidence in court.

With regard to somebody else's answer regarding solicitor/client confidentiality, it's a solicitors job to look after the interests of their clients, imagine if the law was changed the judge could ask a solicitor, "did your client do it?" and the solicitor has 2 choices, either lie and protect their client or not work again... Poor choice. However some might think the law doesn't work it is there for a purpose.

I didn't realise it was illegal to record someone if they were bullying you? I know that if they are caught on cctv that's evidence you can use, I'm so sorry you had such a bad time anyway (in the UK) we don't really have a right to privacy...i hope you can get along well in life now best of luck and yea the law does suck big time in some areas like for example the confidently under the solicitors code of conduct that can be used to protect all kinds of terrible people and thats just horrible a thing that should be changed as well, who knows maybe you should take up law and try to change these type of things :)

To person below:Ok then you completely took my statement the wrong way i meant in the cases of extreme rapists/child abusers/ murder's not just your average person i know of someone who recognised a child abuser at a family tribunal and the law society said that it was against the code for her to notify the police so he got away to do his evil deeds again that's the type of situation i felt needed to be taken into consideration in the code.

The police officer that gave this advice was WRONG.

As an individual you can record such things. The police are not allowed to tell you to do this as this would then be under the Regulation Of Investigatory Powers Act, this is the act that the police or other similar agency have to comply with in order to covertly record.

The one thing that you would have to do is ensure you werent enciting the other person to do the acts of which you were recording as this would then have no value in court

My attorney suggested that I go to Radio Shack and get a small recorder to record my ex husbands threatening phone calls. Its not illegal to tape this to protect your self. This was the only way I ended up getting a restraining order.
