A friend of mine is getting divorced. It is a mutual divorce. They have been married for 4 years. They own no property, have no kids and owe less than $5,000 in credit card debt. Is a lawyer necessary in this type of divorce or can it be done on their own?

No, it is cheaper to go to the courthouse and obtain the necessary paperwork, pay the appropriate fees and file for divorce...the reason I say this is that there are no real assets, children (custody) or other extenuating circumstances which would complicate the divorce proceedings that would require the aid of a lawyer. Just talking to divorce lawyers will usually cost around $300 per hour. If they make xerox copies of joint assets such as bank statements etc they will charge you for those copies...basically they are expensive!

My ex-husband and I got a divorce without lawyers. In Maryland if is called a no-contest divorce. We went to the courthouse, filled out papers, payed 100.00 dollars and waited for the judge to sign the papers. My county also offers a free lawyer for counseling every Monday and she helped us fill out the right forms. The library would be very helpful too.
