I would not put in a chain link fence without it. Without a rail, what kind of support are you giving to the chain link? You will get poor results, fence will sag and bow out of plumb.

We have recently installed a chain link fence without a top rail. Two metres high with three strands of supporting wires top, middle and bottom. The posts are approximately 3 metres apart. The installation have been given a 25 year guarantee against material failure.

You can go without it, but you will eventually have problems with the fence sagging. The top rail is there to provide support for the fence and to keep the vertical posts from pulling in toward each other. The fencing is heavy.

I've seen them without the top rail, but they always have a wire threaded through the top of the fence fabric. All right for a farm fence I guess.... don't like the look of it.

It would look better and be stronger with the top rail. You should buy aluminum fence as it is maintenance free and looks like wrought iron.
