Okay, first of all, I did not leave my children with her knowing that she was leaving them with her teenagers. This all just happened recently. I have removed my kids from the situation, they are no longer in danger. There was never another instance of this prior to me placing the kids there, I could not have known, nor would I ever suspect it. I have torn myself up enough as it is knowing that I was paying her to do this. I do not need any more help feeling any misplaced guilt about it. Thank you

If you knew that her teenager tried to molest your child why would you even use that babysitter at all? Instead of sueing get another babysitter and then ask yourself why you put your child in harm way after knowing all of this. You couldn't sue her because any judge would say you knew she was a bad baby sitter and still used her.

You cannot sue for neglect. However, you can sue for breach of contract. This is a civil issue. You could also file molestation charges against the teenager, but it would not be in your best interest to file civil charges. (because you dont sue people that dont have money, like a teenager)
