I have a client who wants to change his hosting to me, but his current host refuses to turn over the SQL database. It is a dynamic CMS site. All the info was entered from the client, so does that not make it his? There is nothing stated in any contracts I have read? Know of any legal actions?

This really depends on the agreement that you agreed to when you signed up with their service.

If there were provisions covering this topic within the user agreement, then yes, they may be able to. However, if you live in a country other than the country of your hosting company, or they have an improperly worded agreement or fail to address their right to withhold your data, then they might not be able to do it legally.

Now, just because they can't refuse to turn it over legally doesn't mean that they wouldn't withhold it; lawsuits are expensive & arbitration can be too (depending on the agreement)... . even if they are doing something illegally, if you don't have the means to cause an issue for them legally then there isn't much you can do about it.

Hindsight is always better than foresight, but if you have a website that updates a lot (especially dynamically w/ user input), you should do daily backups on it yourself. I've lost entire websites because I failed to do backups. . .

It'll have to be said explicitly on the contract that regarding data of a customer that it'll be ruled on your favour.

If the contract is not explicitly on your favour it will happen the way whatever is convenient or safe for them to do. Henceforth I read and loop every customer agreement carefully before I sign it.
