i think this is still adultery. the bible has a clear meaning of what adultery is (b/c marriage was meant to be forever and divorce was only in the case of some kind of sexual immorality), so even dating after divorce and remarriage etc. is to be considered adultery. that's a bit extreme, but i would call my husband out on it if the papers had not been filed and he was in a relationship with someone. now in your case, there should be something that you can do about it. what is his reasoning for not signing the papers? have you two made any attempts to salvage your marriage? if so he needs to know that you both need to move on and the sooner the better. good luck.

You might be but I dont think its bad because if the papers are filed and he wont sign them then its his fault. My ex-husband was dating and living with his girlfriend/fiance after he left me & before I even filed divorce papers. So if you are in a relationship while still married then its your husbands fault because he wont sign. But be careful he might be able to get you for it. I wouldn't put anything past a man. No its not-after a year in NY state if a couple doesn't live together you can file for a no-fault divoce -don't know the law in your state but they don't use adultery too much anymore for grounds for a divorce.

Leagally yes. If you have already split everything and there is nothing left but the formality then no problem, otherwise he can bring that to court and it can work against you.
Affairs are not illegal but sometimes they sway the judges opinions.
