I got married in June, I haven't changed my last name legally mainly because of all the debt I was carrying when I came into the marriage, credit cards, accounts, etc. It seemed easier to just use my husband's name or a hyphenate socially, well now my mom is writing checks to me with the hyphenated last name, and the last time I was at the bank I was told since I didn't change my name legally they couldn't cash them with the hyphenated name. Does anyone know if the teller I spoke to just didn't know what she was talking about or if this is really going to be a problem?

Fix your name. Be consistent. You can't just make stuff up with hyphens. Do it all legally and you'll have a much easier time at the bank and DMV.

My husband is a banker so I know the regulations. You cannot cash/deposit and checks that aren't in your legal name. How would they know the check is actually for you and not for someone with the same first name?

We had to wait until I changed my name legally to cash some of our wedding money. Just the way it is.

Yeah... Trying to cash checks made out in a name that isn't yours will be a problem. Pick a name and make it legal.

You need to have checks written to you in your legal name.

Also be warned that this may cause you problems with the IRS during tax time. You will be much more likely to be audited at best, at worse, the IRS will confuse you as two different persons and want to be paid twice for your taxes. To fight that you will need an attorney and many trips to court. You will ultimately win, but it will cost you plenty.

Good luck.

you have to do it legally- that is alot like me making up a last name....and bringing it to my bank to cash the check..they wouldn't let me - because legally - it is not my last name.
to change your last name: If you want to - you have to change it at the social security office- you will need your marriage license(certified copy) - and your license..and whatever else they ask for.
Then..you will need to change your drivers license -

The teller is correct- because legally - it is not your last name.

you have bigger problems than a check.

change your last name to his.

combine ALL your accounts as fast as you can.

NEVER let your mom write only you a check.

He married you as you were, as you did him, now you two are one.

IF YOU KEEP THINGS SEPARATE IT WILL EVENTUALLY DESTROY YOUR MARRIAGE.
