Let's be clear about this (sorry about the pun). It is not illegal, full stop. It is indeed an MoT failure, but that it irrelevant - it does not make the car unroadworthy and thus illegal, it just means it would fail an MoT test if tested now. There is no offence of having defective washers.
It is however illegal to drive with an obscured windscreen - if your windscreen is clean and clear there is no problem. It is, of course, unwise to drive like that. You could always carry a wet sponge and squeegee with you if need be . . .

Its not illegal, however if the police see you driving with an obscured windscreen they could stop you and as that you have it fixed in 7 days. Also on the MOT if it does not work the car will fail.

Technically, yes (Are you in the UK, yeah?)
Having no 'skoosh' (!) is an MOT failure, and as your car would fail an MOT it is considered unroadworthy, and unroadworthy=illegal.
In reality though, as long as the screen is clear, and your veiw is not restricted, you aren't even likely to be stopped or checked...and if you WERE, you would only likely get a 28 day V-Rec notice (Vehicle Rectification Notice), which you would have your garage sign after the repair, for you to send to the police so they know it's done.
Don't panic though!

a. use the wipers and make it smear all over the place

l am sorry to hear you have this prob, if you mean the window wipers then its too dodgy to risk it, though the motor that drives it all is quite easy to replace.
If you mean the screen washer with the water in it....first off try a really simple test....pull up your bonnet...and try the washers if you(or a mate) can hear the motor whirring then it might just be a blocked jet. so what to do.....get a hose...put it over the jets one at a time....and push the water through....then try again.....if though the motor is dead you can buy replacements....easy fix...

Yes it is illegal to drive without screenwash because you have no way to keep your windscreen clear should you drive thro' mud etc. a friend of mine failed his mot because he let his washer bottle run dry.Hope you get it sorted soon.

Yes, it is illegal because by law you have to be able to see clearly, so that includes wipers as well.

Ha ha ha ha ha shop dudes are hella funny. Dude is just pulling your leg getting a rise out of you......... Don't know what state you are in therefor it's hard to say. Here in CA I know for a fact that it is not illegal. Also not sure what a MOT is here we might call the same thing smog.
