At the moment, Maddog, you got the points unless someone more skilled at editing than either you or I can find another mistake that the author made in this short example.

Because we are talking about humans, 'that' should be 'who'!

I'd recast the sentence to read: "We have civilian due process rights for criminals prosecuted by the government."

Also the word "civilian" may be superfluous unless the context of the article had to do with non-civilian entities.

misplaced modifier.

makes it sound like the rights are prosecuted when it is really the criminals.
