Like some people have said, the Patriots traded their first round pick in 2007 to the 49ers for a 2007 4th round pick and a 2008 first round pick. So the Patriots have 2 first round picks next spring. Of course, one was taking away due to cheating, however, the Pats still have the 49er's pick, which cannot be taken away. It is not guaranteed to be a top 5 pick, but the Niners are doing awful, so it is expected to be very high.
Another interesting thing about that draft that not many people know -
The Colts made a similar trade with the Niners. They traded their 2008 first round pick and a 2007 4th round pick for the Niners' second round pick.

The Patriots* acquired the 49ers 2008 1st round pick and 2007 4th round pick (#127 overall) by trading them their 2007 1st round pick (#28 overall). The 2008 1st rounder will be the Patriots* only pick in the 1st round due to their punishment for cheating. Most likely the lost pick will be in the 28-32 range of the first round.
The 49ers used the 28th pick to select T - Joe Staley, Central Michigan, while the Patriots* used the 127th pick to select DT - Kareem Brown, Miami (FL.)

The Patriots shipped a fourth round draft pick to the Oakland Raiders for wide receiver Randy Moss.
This pick was the one that they acquired from the San Francisco 49ers in addition to the Niners 2008 first round pick in exchange for the Patriots first round pick at #28
So in effect, the Patriots traded the #28 pick for Randy Moss and the 49ers first round pick next season.

They traded their first round pick to get Joe Staley. I like to see is at a thank you from the 49ers when they traded their 1st round pick in 1985 to New England to draft the greatest wide receiver of all time, Jerry Rice!

They traded last years 28th pick for this years SF 1st pick. They had 2 1st round picks this year but they lost their own pick. So now they are down to 1 and its going to be a top 10(hopefully).

Cause the Pats gave them there #28 pick last year, but it don't matter cause we won't get it know cause of the whole cheatin' crap, man and the 49ers really stink we coulda got a top 3 pick probably.

They traded for it...Thats the one they won't lose...because the trade happenned before the video thing...What they will lose is #32 after winning the Super Bowl...
