i was aguing with my friend that if you speet on some one face that is a crime,but he was saying that speeting on some one face is not a crime so i will like to know if i was right or wrong,thanks.

Spitting on someone is unjust vexation and it is a criminal case under the Penal Law.

Spitting on someone is considered as battery. Even though spitting on someone isn't likely to cause bodily harm it's still unwanted physical contact.

"Assault refers to a threat of violence. This threat may be plainly stated, or implied by a person's actions. Battery is an actual violent act which causes physical harm. Assault and battery covers acts that range from spitting and slapping to inflicting serious injury."

They might be able to get you on disorderly conduct, though I'm not too familiar with those details. I know that it would likely only be a misdemeanor offense, if any at all, so no jailtime.
