Is it still considered a crime in 2007 for a married Muslim man to committ adultery with an unmarried woman? In Canada it is not looked upon favourably but it is quite common. How common is adultery in Morocco and do they prosecute ??

Important Note:

First,let us clarify the terminology.

Zina Arabic for adultery is simply sex without marriage.That has a different rule.Specifically,it is jsut prostitution.And that is the one Misviv talked about and its punishment(confinement for life).

cheating on one's partner is called marital Betrayal.and that's the one you want an answer for.

Do not asume that all Islamic countries apply the islamic law taken from Quran (Shariaa).

Islamic law is only in effect in 3 major countries-Saudi Arabia Iran,and Sudan.

Second,Muslim countries have different ethnicities,languages and traditions . and Traditions MATTER.

the Philippines is a christain country, how much in common is shared between a philipino and a Canadian or a greek citizen ?

So seeing all muslim countries the same is naive.

Morocco is ethnically Berber not Arabs,but Arabs came later and mixed with them thru marriage .Geographically,its location is near to Europe,it is a mediteranian country. They have been invaded by the Romans,Spanish,French ,Americans were there too. Morocco also invaded Spain,portugal and Moroccans emmigrated to France,Italy,Germany and rest of Europe.Once back,they brought with them some of Europe liberal habits to their country .They have interacted with Europeans more than they did with any arab or muslim country.

Many Moroccans have mixed blood-they are partly Berber,partly Arabs,partly Spanish,partly Jewish,partly muslim.That is why their cosmopolitan personality and character is different and unique.

First islamic law(shariaa) is not applied in Morocco (as in Saudi arabia or iran) . They apply a man-made law taken from the French law during the time of French colonization.

The current Moroccan law ( a secular one) prosecutes either cheating party-wife or husband .but ONLY if either one formally file a legal suit.

Do they usually file a legal suit .?

Many a time Not.

... for fear of public defamation and or lack of evidence .

For these reason,adultery is a little bit common and does not differ too much from other countries regardless of religion.

Calling any Moroccan walking in the street a perfect muslim is like calling any American walking in the street a perfect christian.Born-muslim is simply like born-christian does not make one either.

I explained the geographical and ethnical part so you know where a Morcoccan come from.Looking at them thru that sterotyped and generalized muslim look is completely irrelavant.

To initiate a legal suit,the first contact would be the Moroccan embassy in Canada.

It is against Islam to commit adultery or fornication for a man or woman. Depending on the country (whether it adheres to Islam or not) it can also be a crime.

There are cases of prosecution in Morocco though they do NOT USE SHARIAH LAW. Here they only require one witness and recent cases here that I am aware of locally this was/is the case. The wife filed for divorce, brought a witness to the husbands crime. The husband is now no longer the husband and he is in jail.
It is not always easy to prosecute adultery here in Morocco as it isn't flaunted. For that matter unmarried men who do commit fornication don't share stories on their escapades even with their friends. It is a shame do be doing this and more of a shame to speak of it.

Again our resident untruthful 'person' Misviv is misinforming people. She/he is an Islamiphobe (likely among other phobias, poor kid). I do believe she is just straight up lying but I suppose it is potential that she is just completely ignorant to the facts. The poor girl is confusing laws of some countries where Muslims happen to live with the laws of Islam. These are two different things. No nation follows shariah law in it's fullest and only one come close to it (KSA). It is NOT part of Islam to require four witnesses to rape in order to prosecute it though a few countries may apply a law like this on their own. Too bad for them but for someone to claim it to be part of Islam is surely uninformed.

If we believed that what a country whose majority population was Muslim does was automatically part of Islam then we would have to believe that the rules Turkey has in place to ban certain Islamic practices was actually Islamic. We would have to believe that Turkey was a good, pious nation which it is not.

What MoRmeX said is right, they go to jail.

Having 4 witnesses is a protection against gossip claiming somebody did something they are not supposed to do.

I'm not the expert but based on Sharia law it takes 4 witnesses to testify that a man committed adultery.
I believe adultery is common throughout all countries unfortunately regarless of whether they are Muslim or not.

The best of men are those who are good to their wives.. I am lucky I have a good man. He helps me so much. He works 12 hours a day and will come home and help clean or cook etc... only thing I really have to do is care for my son..... When I am sick my husband will wake no matter what time and he never complains... Allah(swt) has surely blessed me with a wonderful partner.

Since when common equals right? yes it's a crime to cheat on your wife, in morocco if caught u can get up to five years, i recommend this law for Canada too, this way we will see less broken homes less unwanted kids and less crimes..etc.

Most religions consider adultery a crime. Islam goes to the extent of making it unlawful for man and a woman who aren't related to be alone together in a private space (khalwa). This is a religious crime albeit a minor one. But the muslim society is more forgiving towards men as they are allowed to go on prospecting for new wives after marriage.

The punishment for adultery (zina), to quote the islamic texts:

The first revelation concerning the punishment of zina was that a woman guilty of zina was to be confined to her home until she died (An-Nisaa' 4:15). The second revelation covered both men and women and was not very specific regarding punishment:

[And as for the two who are guilty of indecency from among you, give them both a punishment; then if they repent and amend, turn aside from them; surely Allah is Oft-returning (to mercy), the Merciful.] (An-Nisaa' 4:16)

Allah Almighty then revealed:

[(As for) the fornicatress and the fornicator, flog each of them, (giving) a hundred stripes, and let not pity for them detain you in the matter of obedience to Allah and the last day.] (An-Nur 24:2)
