ok so i am a 19 yr old college student instead of dorming i was going to get an aparmtent...my mom and i found this one aparment with the lady from a realty...so it like a gated community and i needed to fill out an application cost $200 to see if i would get approved..i did and everything was set for me to move in next week...now they called and said that i cant move in because the association doesnt want someone underage because they cant be able to pay for it..which my moms name is on the lease with mine and shes going to pay for it...we already gave a deposit 2..is that age discrimination and can we sue?

someone owns the aparment and is leasing it and he had no problem...

In the US age discrimination is anyone over 45. To disallow anyone under 21 is perfectly acceptable. I can't believe you did not see anything in the application though, it should have been stated somewhere up front.

If there is NOTHING in righting about being under age or not you should be able to sue and get your 200 back. You can't sue as discrimination, but as deceptive marketing practices.

Age discrimination doesn't apply to being to young for something, it only applies to being OVER a certain age. So no, you can't sue for age discrimination.

What is the difference, too young - too old you are being discriminated against, the only question should be is your money green??

Unless your mother is going to live with you, her name will not be on the lease. She would only be a co-signer, if they offer or allow co-signers - they do not have to.

They can reject you if your income, rental history or work history does not neet their criteria.
