we are renting a house and have made payments to the owners through a leasing co. the last 3 months our payments have been going to the owners at $1242.00 per month ... and I feel that they are pocketing the money! collection agency is asking for payment in full from the owners in the amount or over $3,000.00,....my question is are we still obligated to pay rent and to whom if it looks like they are defaulting in their payments? .. we opened a letter to the owners stating to "cure" or "reinstatement right" and they are also seeking payment for next month. (december) and also regarding foreclosure..where does this leave us? what are our rights? what happens after December? we have been here for the last 2 years in good standing. My room mate wants to continue paying rent and I say no. what is legally correct? does this mean that they filed banckruptcy??

Opening someone Else's mail!!! ugh NEVER. Big illegal. As for the question if the landlord is pocketing the rent, that's really up to them, its there property and if they pay for it is up to them. That said it is a bad situation for you if you have to move. Continue to pay rent, you are legally bound to pay rent. Though you should defiantly be look for a new apt. Keep an eye if the house is going to sheriffs sale. People do refi to prevent foreclures, its what i do for a living. The only thing you should worry about is paying ur rent ontime and to have an option if u get a 30 day notice to move.

The first respondent is correct. What on EARTH were you thinking while opening mail addressed to someone other than yourself? That IS a federal offense.

Meanwhile, you owe your rents to the owner of record for the period you are living there. It's NONE of your business what happens to that money. You owe it to the owners.

If a foreclosure occurs and ownership changes, you will be notified by mail addressed to YOU about changing the party to whom you pay rents.

You realize you could be prosecuted by the federal govt for opening someone else's mail? Not smart.

I suggest you begin packing and looking for a new place to live. I don't advise NOT paying rent, but nor is it your responsiblity to see the the lender receives it either. If you want to know your legal rights, I strongly urge you to consult with an attorney.

Yor best bet is to ask a local Lawer about renter rights.
