Being on disability does not stop your employer from taking otherwise legal actions. You can be fired when on disability as well. You just can't have your pay cut or be fired BECAUSE you are on disability.

Please check with the labor board as well as with a lawyer.

I my self was on disability from my job for a year and I wasn't demoted nor did I loose benefits.

I went back to work for and a day and an hour and was re-injured, since the injury was not completely taken care of through the first surgery. I went back out on disability and in total I was off from work for a total of 15 months. I went through a second surgery for the same issue.

Again, I was never demoted nor did I loose any thing due to the disability.


ONE more thought: If it was an on the job injury I doubt that they can fire you or demote you since it happened at work, they would look pretty bad.

They may end up in the funny papers. Check it out so that you will know exactly what your rights are.

with no details, we don't even now what yo regard as "demotion".

Is this how you would ask a court?
