Why stop at child rape? What about murder, or other really violent offenses. Or how about white color offenses that are not violent, but cost society billions of dolors like embezzlement or severe pollution.
Think of all of the companies making huge profits polluting common resources like rivers and lakes- causing large numbers of people to get sick or even die.
So what's worse- child molestation, or being the root cause of
1000 people getting terminal long cancer in the name of company profits.
It's a tough question- and my answer would be the death penalty is the wrong answer for any of them- mainly cuz you can't take it back if you get it wrong in the court room.
And as the courts are now- it would me cheaper to build more prisons to house criminals for life than try them for the death penalty since it is so expensive to try a death penalty case

Due to the finality of the death sentence and number of people freed after DNA results proved conclusively that they were innocent I would have a little trouble with that.
On the other hand if it were proved conclusively that the person is guilty then by all means a PUBLIC EXECUTION would definitely be called for.
I have no problem with the death penalty just the we be absolutely sure as once it is carried out that ends all.

Iwatched a 20/20 program a while back. It had a man who was in orison for 12 years, for raping his 11 year old niece.
She testified at the trial that it was him.
12 years later, her panties were tested forDNA and the DNA did not match.
It did match another person in the neighborhood, that was same build hieight and similar looking.
The Uncle was released, the niece wept on the program, she really thought her uncle had betrayed her and committed the crime.
she was wrong
good thing they didn't have YOU as the Judge
many eye witness's are wrong !!!
I agree, if we find the girl in the mans basement ties and abused KILL HIM
but when there is a chance of innocence
error on the side of caution

The obvious problem is the fact that we have had a rash of innocent people on death row.
Second, due process means that you stay on death row for a long time before the deed is done.
Mainly, your solution ignores the fact that child rapist make up a teeny tiny part of the prison. Non-violent drug offenders is the real problem for overcrowding.

You say "confirmed Guilty".
If a criminal is found Guilty, then either he is, or the jury failed him.
In order for a person to be found guilty, the jury has to be 100% sure that he did it. That is the concept of "Innocent until PROVEN guilty", a practice by which our courts must abide.
That being said, if someone is found Guilty of raping a child, we should execute them. Child Molestors and Child Rapists are the lowest forms of life that exist. We should allow capital punishment for these crimes.

What do you mean by "confirmed Guilty"? Your either guilty or not. That crime makes up only a fraction of the people in prison. Something like 70% of people in Prison are in there on drug related charges.

The overcrowding is more from the huge number of drug users (not so much the dealers) that are in prison. Real criminals like the sex offenders do need to be locked up indefinitely but I do not see that as a death sentence type of offense unless the childs life was taken.

First start by letting out all the people in prison for possesion of marijuana. Next let out all the people who stole food or money to feed their children. Then we can talk.
