No! He is in breach of your terms and conditions and therefore...your contract! He has no entitlement to do this and it is illegal.
Contact ACAS and ask them how you can challenge it!
I am assuming you are not in a trade union...if you have to ask on here?
Let's dispose of this nonsense that an employer can 'claw' back annual leave entitlement.
It is a CONTRACTUAL and LEGAL right! It CANNOT be arbitrarily or unilateraly removed.
Why do people answer these questions when they don't know what they are talking about?

It is written into our contracts - my employer calls it payback.
If we are off for more than the alloted sick period (short term sickness only) which is 9 days we have to payback any sickness days overthat from our holiday entitlement or our salary is cut for the extra days.

No, you are entitled to 4 wks holiday a year, it has nothing to do with being sick that is an entirely different matter

No I don't think he should do that because you had no control over getting sick and it isn't your fault. He should be more understanding and still give the holidays off. Plus its not like he wants to be at the office to supervise you over the holidays any way.

NO he should not be able to take away holidays. He should however just take away your sick days for two weeks worth of being sick but not holiday days. Holidays are national days off so he should not be able to force you to work holidays if everyone else is off.

I don't know about the UK, but in the US, you are allotted a certain number of sick days. If you exceed the sick days, then they may dock your personal time or vacation days. You are lucky you still got paid. It could have been worse.

If you used up your sick days then you have the choice of having the extra days off as unpaid, or using up a holiday.

Depends on your hiring agreement. If it's a small business and you basically had no formal agreement, other than pay and stuff, then yes, your employer can do that if he/she wants. They can fire you, if they want.
If you work for a place with a uninon, then you have some protection, but you'd have to call your rep and check it out.
