My ex has not made a payment since the end of july ~ the CS agency sends him reminder letters, I demanded the cs order be enforced. A hearing will be scheduled. How much longer will I have to wait?

Unfortunately he is considered an Independent contractor (gets paid under the table) so cant garnish the wages but he does HAVE assets. I know he makes a lot of money on jobs ~ he even has his own crew!

(I APOLOGIZE FOR MY EARLIER COMMENT!) I'm not excusing the fact that he's being a deadbeat dad, but don't wait around and make him the excuse why your kids don't have presents, food, clothing, etc.
To Gypsy G: Sorry about your situation! I have an ex who gets a heckuva chunk of my paycheck, plus I pay their insurance premiums, ... she's a college grad, yet refuses to work. So I shouldn't have made the same assumption here.
P.S. On my original answer - the agency will see that he pays you back support from July to the present. Trust me on that one! If he doesn't, they can garnish his check and even go as far as suspending his driving privileges (in some states).
P.P.S. SPIRITED, if that's the case (him being an independent contractor), there's always the chance that he could be denied licenses when it comes time for renewal. Every state has their own laws, but many are starting to get on the same page. Also, if he has a checking account, he may be surprised one day when he finds that the child support agency got a court order to take money out of there.

I work FT and I make a very decent salary and I'm still about $200 shy every month, after paying for the exorbitant childcare costs. I make too much to qualify for aid and I don't make enough to cover the basics. Its tough out there. And don't give me the sh!t, then you shouldn't have children. Because if that were the case then there would only be about 1/4 of the population. And my odds are that you wouldn't be here if that were the case.

lol i understand what you are going through i havent had a christmas since i started paying support 10 years ago so whats the big deal you will have to make ends meet somehow so dont blame no christmas on the deadbeat dad which he is but its up to you to provide support for the kids also and yes i have since remarried and also work 2 jobs because half my income is being blead out through child support so you just gotta do something to better your own situation
we are all shy when it comes to monies everyone it seems has to do without something in order to get by but you gotta help

Look I got custody in July (had 50/50 before that) and my ex has never paid. I got a hearing in December and was told that he would have up to 30 days after that to pay.

Find money some other way... he's gotten away with not paying cs this long... chances are he never will... just give excuses you'll fall for. If you want a Christmas for your kids, find another way. DO NOT depend on help from him.

It's tough but you have to just accept the fact that you are never getting another dime. You might, but you cannot rely on it or expect it. You have to live your life like you are the sole provider, emotionally as well as financially.
My ex doesn't support our son financially (owes $73,000 - yikes!). He must be feeling some guilt about that because now he never visits him or calls either. How sad! I've become both parents. Lucky for our son, I like the job!

There is one way to make the government move on him, apply for food stamps, if approved even for $1.00, the state will hunt him down and make him pay his child support, its terrible to do this but it works, the state wants their money back and that is why they push so hard when you are getting assistance.

Child support is not guaranteed income and should never be relied upon. Is it fair? No! Fathers should support their children.
My ex owes me over $19,000.00 in back support, my baby just turned 23, think I will ever see it? I think not. I survived and worked harder where there father was lacking. Never kept him from seeing them, figured he was their father and he could and did dig his own hole.
