he should watch out, dont these already exist under a patent?

One of the first things done when getting a patent is a patent search......This ensures that "it" isn't already patented....

Plus if the two "its" aren't exactly the same a patent may still be issued for a new design on the same or similar concept...

You cannot get sued simply for inventing something that has already been invented. But, if a similar product is patented and he tries to sell his, then he would be guilty of patent infringement. The cool thing about it though is that he was able to come up with this idea on his own based on a need that he saw in the world. Also, I think his mother isn't that bright if there is a pattern of the toilet seat being left up and she still doesn't bother to look. As they say, fool me once shame on you, fool me twice shame on me, fool me several dozen times and I must be an idiot.

i think the patent is on one that lowers the seat after use.
