You can get used to it or move. It is not illegal for the woman to smoke in her own apartment and it should not be affecting you so much that you want her to quit. Her ceiling and your floor should manage to stop the smoke from rising into your apartment and the only other place there may be a problem is in the hallways or on the stairs. This should be only a minor and negligible irritation at most.

Called 311? Obviously you are not talking about that lame alternative band, but who is it? is it some local housing authority or something?

Fact is, unless the landlord has made the entire premises smoke free, you are out of luck, and you should be. If you dont like smoke you should have picked a smoke free place from the start, not move in and expect people to cater to you.

If that had been me downstairs and you came down to complain, it would not have been pleasant. I understand non-smokers, but it seems that smokers are attacked by everyone else and always being crucified for smoking in bars or in public... is it gonna start at homes now too?

Oh and how exactly are you smelling it anyway? do you have holes in your floor? i dont get it...

You can't do anything at all. As much as the smell may disturb you, the fact is that she has the right to do whatever she wants in her own apartment as long as it isn't illegal.

Having lived in NYC many years ago, chances are, on occasion you probably do things that annoy your neighbors, you either have to deal with it or move someplace else.

All these negative answers from pro smoking people just about define them, How can they say it's the on smokers problem,it's great to see the prats outside pubs in the freezing rain in the uk can't wait till the proper cold kicks in and there stupid tag along non-smoking mates have to stand out with 'em ,sort yourselves out smokers,whats it all for ?

How can she get you to stop?

She has the right to smoke in her own home - you have the right to buy some boxes and move.

By her 6 truckloads of cigarettes for Christmas. She will smoke then which will be annoying at first, but she will get sick and die all that much faster.

Nothing. She has a right to smoke in her own home. If you don't like it.. move.

Not that I support smokers, I don't (I made my hubby quit), but she is not breaking any laws so there is nothing you can do about it.

If this does annoy you, the answer is simple. Move to a smoke free building.

Unless the building is "smoke free" there is nothing within the law that you can do.

So you went downstairs and tried to get her to stop because YOU don't like it? Does she come and see you when you have sex and make too much noise? Get a grip. If it had been me, your ears would have been burning when you left.
