I'm not a lawyer, sweetie, but to the best of my knowledge, most judges no longer impose jail sentences on BP22 and estafa cases. The fact that your friend was already able to collect some form of payment from you clearly indicates that there was no intention on your part to defraud her in the first place. For the existence of the crime of estafa, two elements are indispensable: fraud and damage.

As I answered before, BP 22 is not a criminal offence anymore. Majority of the times, they will include estafa in the case to make it heavier. If you do not have the intention to defraud, you have a strong case. If they do not have proofs, you do not have to prove anything. Also, if you're willing to pay as you said but do not have the means, you will not go to jail. All these circumsances must go together in order for you to remain free.

Not knowing the circumstances of this case, I would say Yes, people could get jailed for estafa. If she is able to prove that you are guilty, and the court renders a guilty judgement, you will go to jail.

It depends on the situation darling and ifever... try to approach a lawyer for legal advise. Don't be scared. That friend of yours doesn't care if s/he ruined your reputation just because you can't pay her/him right away. Karma and time will tell for him/her. Anyways, try to fight for it and approach a lawyer in the court is/he doesn't want to compromise with you.

Accdg. to our family lawyer:
The Disadvantages of your friend if you fight with him/her at the court:
-It will take a long time for you to pay for him/her due to court hearings and she will only waste his/her money on paying a lawyer.
-The court will reduce the interest you owe her.
-Ifever the judgement will be in favor for you... s/he will pay you for moral damage, your lawyer's fee and other damages.
-S/he will lost more money and a friend.
-Karma for him/her.

So don't be scared and tell your so-called friend.
"I'll see you in Court."

ADD: By the way, did you use a Bank check and it bounces?
If so you might be jailed but you can pay a bail for your temporary freedom.. I hope you'll get over this soon. You better ask for legal advice now.

If she has money for the lawyers she will win. You know who ever has the most money to though at the case will probably win if she really takes it that far. Most of the time people just say there gonna do it and never do.

I have a question too. What if my mom was just forced by my dad to sign the check not knowing that she will be imprisoned because of it if it bounced ? Also not knowing she will get imprisoned if it bounced should we file and affidavit for it? And what type of affidavit?
