Any person who is already married & having living spouse cannot marry second time as it will amount to bigamy. This the general rule applicable to all but Muslims who can marry & have four legal wives at one time, provided they married these wives according to their religious form i.e. according to Muslim Shariat law & not according to Civil or court marriage. In case a Muslim Marries any lady according to civil or court marriage he shall have to first give divorce to such wife before he marries a second time otherwise he shall be bound by the civil form of marriage law which is the Special Marriage Act, 1954 in India that prevents any second marriage by him even if he is a Muslim & his religion allows such a second marriage. In any other case i.e. person belonging to any other religion cannot legally marry second time till he dissolve his first marriage, whether such first marriage was preformed by civil or court marriage form or his religious form, in any case he is bound by this marriage & unless he dissolve such a marriage by decree of divorce or annulment as the case may be he will not be allowed to marry again legally, but if do so he can face punishment for the offence of bigamy under the provisions of section 494 of the Indian Penal Code in India.

your question is not clear. of the person concerned is already married. whether religiously or in a court of law , cannot marry again. If a unmarried man want s to marry a widow in a court of law, there is no problem

you have to get a divorce first, unless your spouse dies.
other than that it is polygamy and it is against federal laws in the US.
