my father died In July,he and my mom were still married but they had been living apart for over 10 years,Is she legally entitled to his retirement.He was a government employee before he retired
for over 25 years.My mother was told that he didn't have anyone as his beneficiary.Also my ex husband just died and we had been married for 35 years,I divorced him 2 years ago and have been married for 11/2 years now.Am I entitled to his retirement?If not what happens to it?

Usually the retirement goes straight to the wife regardless of beneficiary listed. As far as SS it depends on your age, how long you were married, and if there is any ex's that can claim as well.

Your mother is entitled to your dad's social security or to hers--whichever is the most. But she has probably been collecting social security for years, so she needs to talk to the SS office now that your dad is dead. She is also entitled to widow's pension. She should go to a social security office and talk to them to see how much she would get. This is something she is legally entitled to if they were still married. As for your dad's retirement, I have no idea. She would have to contact his employer.

If you are over 62 and so is your present husband, you would only be entitled to collect on your present husband's social security record or your own if you worked---again whichever is the most. However, if you were to divorce your present husband or he died, then you could collect on your former husband's social security if it was more, because you were married over 10 years. If your present husband dies, you can collect widow's pension, too. A SS office can give you all of the details.

As for your former husband's retirement from a company, I don't know what their policy is since you were divorced.

And NO! You are not digging for gold! Social Security benefits are something that a person has been paying for, and is legally entitled to!

I have to agree with one of the answers before me. Dont' ask anyone on here. You can contact an attorney who usually give free consultations. All you're gonna get on here is someone who's gonna state the obvious, they feel yes your mom is entitled because she's his wife. I'm sure there's a lot more to be said about it. As for you, why would YOU be entitled to his money???? You're divorced and married to someone else.
