I requested a hoe warrenty on my sales contract since it was brought up by the seeling agent. I was expecting to bring in 300 dollars for the warenty at closing. We only needed to bring in 150 dollers since the seller was paying 3500 toward closing. now 2 monthes after moving in the heat and air unit dies and we find out the closing agent did not include the warrenty. What can I do? I turned down a warrenty with my insurance company because I was under the impression that it was included at closing. Now we have to come up with 4000 to replace the unit. what are my options

Did you specify that a/c and heating must be operational...or you bought "as is".??? Check out your paperwork and talk to the agent that sold you the home.. ..Maybe that person messed up-- so she has to admit it-- and you can file a claim against her Errors and Omissions insurance company!!

If it wasn't listed on the HUD 1 statement at closing, you didn't get a home warranty. You have to read the documents before you sign them, because things get changed or forgotten or otherwise screwed up all the time. You're probably stuck.

Did you call the title company or your real estate agent to ask about it? That would be my first step, but I'm betting it isn't there and you need to find the money for a new furnace.

If you have anything in writing indicating that you were due a home warranty at closing, you may have a claim against the agent's E&O insurance coverage. If everything was verbal, you missed checking the documentation to insure that you were getting what you asked for.
