You can call 9-1-1 or the police non-emergency number and ask them how to get a restraining order in your state. In Virginia, you can call but it must be followed up with a written complaint with the magistrate's office.
But if you are in danger go to the police department immediately. If there is evidence of domestic violence the police officer can request the restraining order for you. Once it has been served, there is no contact for the time period specified. In Virginia, we usually do 3 days, then the requester appears in court. If the judge feels there is still a danger, the order is extended for about 2 weeks. After that, when the requester appears in court the judge may extend the order for up to 2 years. All during the time the order is in effect, there is to be no direct contact between the two of you. If there are children with visitation rights, they will be handled via a third party (parent, grandparent, etc).
If there is no evidence of domestic violence, then you will not qualify for the restraining order. But if you are having marital problems, get away from him before there is any violence. Have a family member or friend come for you (and children) and take you to a safe location. Hire a lawyer and move on with your life.
Take care of yourself, I've been there, so I know your fear. Please get away from him as soon as you can.

in spite of if or not he injury you isn't the priority. the priority is that he violated a courtroom order. The courtroom won't condone that. they'll in all threat boost the restraining order, if not make it everlasting. He might get slightly reformatory time so he can sit down and think of roughly himself.

It sounds like you need to call WEAVE. It should be in your phone book. Tell them that you are afraid of your husband and want a restraining order but don't know how to get it without him knowing and trying to stop you. They will be able to help you get what you need.

If you feel you are in danger, you should call the police. You may also want to see about any kind of local women's center that offers legal help for the victims of domestic abuse. If you just want him to leave because he's annoying, it's different, and you'll probably need an attorney.

I think you need to go to the police department, but you can call and tell them you are afraid for your safety and maybe an officer can come to you. Good luck!
