I bought a t.v. on craigslist that was listed as brand new never open factory sealed.
Anyhow, I paid $1200 cash for it, and hauled it home. I didn't open it because it did look new, and it was sealed so I didn't want to pull it out of the box and put it back together again, because it was a pretty large t.v.
Well, I drove it home, plugged it in and it won't turn on!! I called the guy back, and he told me that the t.v was being sold "as is," and now he won't give me my money back. I drove back to his house, and he doesn't open the door for me anymore. what can I do?? Is this considered scamming me? Can I take him to court, or file a police report or something??? Please help, I'm very desperate!!!

He advertised it as factory sealed. It should work.
He must advertise as "AS IS" if he is in fact selling an item as is.

However you have his address, you have his contact information, and as long as you have $35 you can take him to small claims court.

You can take him to small claims court. That could take a lot of time though. He sold it as never opened...not "as is" so your claim is legitimate.

You could ask him for the original reciept and try to get your money back there (although this is a long shot)

Take it to a repair shop (Best Buy). Maybe they can identify the problem and see how much it costs to fix. If it's only a couple hundred bucks....maybe it's worth it.

the only thank you to get your cash lower back may be in case you knew the seller's real call and domicile handle. then you definately might could have info the in the back of the scenes passes have been counterfeit or not obtainable and sue him in small claims courtroom. yet to coach you probably did not get the passes you will possibly could have the venue real you a letter on their letterhead that there have been no passes for you - otherwise the seller is going to declare that the passes have been there and which you're able to furnish info they weren't. in case you're suing him you are the guy who needs to furnish the actually info that there have been no tickets. i can't think of the venue is going to write you a letter pointing out which you probably did not get the tickets - it somewhat is basically too busy on the night of a teach and that they at the instant are not likely to remember you in case you call the workplace day after today i might in no way purchase tickets from Craiglist until eventually i could %. up the tickets in individual from the seller

You sue him in small claims court.

Be sure to keep a copy of the ad. Sales of used items are considered to be "as-is" unless a specific warranty is offered, but new items must be "fit for the purpose intended", so the fact that he advertised it as new is important.

Call the police.

They might go have a little talk with the guy - maybe he has been brought to their attention before and you are going to be the straw that breaks the camel's back.
