can I put a lean on my own house because of a divorse problem. My x wife isn't sticking to the agreement and I am paying everything . The house is to be sold in 4 years and we will have to split the profit . If I put a lean on my house for the money owed , will I get it back on the sale ? Any suggestions ?

Thanks, JIm

Consult with your attorney. It may be possible to have your divorce decree attached to the deed to ensure that you get your share when it's sold. Either that or a lis pendens action to warn a potential seller that there is a possible cloud on the title.

In reality, however, if your name is also on the deed, there's no way that she can sell it without your consent. If that's the case, you really don't need to do anything.

It's lien, BTW.

I agree, consult with your divorce attorney about the best course of action. Is your name still on title? Then she cannot sell it without your consent or splitting the proceeds.
