I don't know that you would need a certain dollar amount, if eBay is unable to resolve your issue mutually then you could take the person(s) to small claims court. The problem with that is if you purchased something from someone in a different state or who does not live close, you will likely incure more costs in pursing legal action than actually recovering your loss.

Personally, I wouldn't bother for that, but I could if I wanted.

Remember though that the suit would have to be filed where HE is, not where YOU are (If they're not the same) and that you can't recover things like travel costs, lost wages, etc.
