I have been served a lawsuit for Child Support for a kid that's not mine. I'm 100% it's not mine because I live in Florida, I have never been to California nor I've met this woman that's listed as the mother.

They list my name, but I KNOW IT'S NOT ME!

I think I should file a lawsuit against the State of California. My girlfriend now believes I actually have a child up in CA.

Any advice? If you are a lawyer and think I have a case, let me know...

It's not the state who is accusing you, it's the mother. Why should you be able to sue a state that hasn't done anything to you?

In any event, you probably want to get a lawyer up there. But, you might start by calling the mother's lawyer. If this really is a case of mistaken identity, and you can convince them of it, then you can save some hassle, because they don't want to go to the expense to sue you if they have the wrong guy.

If you are absolutely certain you're not the father, then tell her attorney you'll submit to a paternity test at their expense at a lab near your home. They'll be able to confirm that you are not her baby daddy, and they'll drop against you and keep looking.

Under no circumstances should you ignore the lawsuit...if you do you will find yourself the father of a child by default....obligated to pay child support and your name reported to the credit bureaus....income tax intercepted and your wages attached....yes even if you live in Florida and the action is in California.

Keep all communication with LA in writing and make sure you commence immediately. Send them a certified mail return receipt requested letter advising them that you deny being the father of the child that you do not know the woman and it appears to be a case of mistaken identity or a case of fraud by the woman. Demand from them a blood test to establish paternity. Once the blood test establish that you are not the father then everything will be dropped by LA.

It will do you no good to threaten to suit LA. They have heard that line a million times and it simply has no effect. They are basing their action on the representation by the mother and they are protected under the law from any action that you could bring at this point in time. Play nice but play firm with them and the matter should resolve quickly in your favor.

Get in touch with a family law attorney and tall them about your situation. They will get in touch with the representative in CA and find out the facts behind the case. This is not something to be taken lightly, and trying to sue the state is the wrong action. If anything it is a mistaken identty, and that is not something that you can sue for unless they had caused harm to you somehow. The person who filed the claim against you might be responsible.
