The whole deal has been bad since day one. They didn't do what the contract stated they would. There are two sets of closing papers. The closing took place more than a month after it was suppose to. They were to leave my first loan in place, but went and paid off my loan without my knowledge and are trying to get us evicted. We still don't even have all of the monies due us. I need to find an attorney who can represent us. We have some money, and we can also barter and trade if needed. This has been an underhanded deal from day one. Please help us save our home.

You will need to examine any documents you signed at the time of closing on this 'equity loan'. If what you signed reflects what the mortgage firm provided, you're in a tough position. Given that you signed the documents, you are expected to understand what you are signing.

If this should come to a legal scenario, documentation always wins over 'he said, she said'.

There should be documentation of what was to be paid by the proceeds of your loan. If the lender went outside of those parameters, they have violated the contract.

You are going to have to carefully review everything you signed, and any other supporting evidence, such as the payoff of the first mortgage.

Then contact a RE attorney in your area. There are lender regulatory agencies that may be able to assist you also.

Do everything in the meantime to make your monthly payments on time on both your 1st and 2nd mortgages. Even if you are 100% correct about being screwed, no one will show sympathy for you in the meantime if you refuse to make payments. If it turns out you were correct, later on you can fight to get reimbursed correctly. http://www.choicefinance.net/
