Cu + HNO3 ---> Cu(NO3)2 + NO + H20

3Cu + 8HNO3 ---> 3Cu(NO3)2 + 2NO + 4H2O

Tiger eye got it! I believe this reaction happens with dillute HNO3 and the NO2-evolving reaction happens with concentrated HNO3.
